1. Introduction
These terms and conditions ("Terms") govern all commissions, orders and services provided by Bear Brothers Furniture Ltd ("we", "us", "our"), registered at Unit 5, 135 Lindsey Street, Epping, Essex, CM16 6RE. By placing an order or engaging our services you agree to be bound by these Terms.
2. Quotations
- All quotations are provided free of charge following a home survey and design consultation.
- Quotes are valid for 30 days from the date of issue unless otherwise stated.
- Quoted prices include materials, manufacture, delivery and installation unless explicitly excluded.
- Any changes to the specification after a quote has been accepted may result in a revised price, which we will agree with you in writing before proceeding.
3. Deposits and Payment
- A deposit of 50% of the total quoted price is required to confirm your order and begin manufacture.
- The remaining balance is due on the day of installation, payable by bank transfer, debit card or credit card.
- We do not begin manufacture until the deposit has cleared.
- For orders over £10,000, a staged payment schedule may be agreed in writing.
4. Design and Approval
- We provide detailed design drawings and, where applicable, 3D visualisations for your approval before manufacture begins.
- You are responsible for reviewing and approving the design, dimensions, materials and finish selections.
- Once you approve the design in writing, any subsequent changes may incur additional costs and extend the lead time.
5. Manufacture and Lead Times
- Typical lead times are 4–6 weeks from deposit receipt, depending on complexity and current workshop capacity.
- We will provide an estimated completion date when your order is confirmed. We will notify you promptly of any delays.
- Lead times are estimates and not guaranteed. We shall not be liable for delays caused by circumstances beyond our reasonable control.
6. Delivery and Installation
- Delivery and installation are included in the quoted price for addresses within our standard service area (London, Essex and Cambridge).
- We require clear access to the installation area. You are responsible for ensuring access routes are unobstructed and any existing furniture or items are moved beforehand.
- Minor remedial work (e.g., filling small screw holes after removing old furniture) is included. Major building work, plastering or electrical work is not included unless separately quoted.
- We take care to protect your property during installation. Any accidental damage will be reported immediately and rectified at our cost.
7. Guarantee
- All furniture carries a 5-year structural guarantee covering joints, runners, hinges, fixings and carcass integrity.
- Painted and lacquered finishes are guaranteed against peeling or flaking for 2 years under normal domestic use.
- The guarantee does not cover damage caused by misuse, neglect, unauthorised modification, or exposure to excessive moisture or heat.
- Natural timber may expand, contract or develop minor surface cracks due to seasonal changes in humidity. This is a characteristic of solid wood, not a defect.
8. Cancellations
- You may cancel your order within 14 days of placing it, in accordance with the Consumer Contracts Regulations 2013, provided manufacture has not begun.
- If manufacture has already started, we may retain a reasonable proportion of the deposit to cover materials and labour costs incurred.
- Bespoke items made to your specific measurements and specification are exempt from the 14-day cooling-off period once manufacture has commenced, as permitted by Regulation 28(1)(b).
9. Complaints and Disputes
- If you are dissatisfied with any aspect of our work, please contact us as soon as possible at info@bearbrothersfurniture.com or 07782 238 898.
- We aim to resolve all complaints within 14 working days.
- If we cannot reach a resolution, you may refer the matter to an alternative dispute resolution provider or the courts of England and Wales.
10. Limitation of Liability
- Our total liability to you for any claim arising from or in connection with our services shall not exceed the total price paid for the relevant commission.
- We are not liable for any indirect, consequential or incidental losses, including loss of profit, data or business opportunity.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation.
11. Intellectual Property
All designs, drawings and 3D visualisations created by Bear Brothers Furniture remain our intellectual property unless otherwise agreed in writing. You may not reproduce, distribute or use our designs for any purpose other than the commission for which they were created.
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, supply-chain disruptions, government restrictions or transport failures.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to These Terms
We may update these Terms from time to time. The current version will always be available on this page with the revision date shown above. Changes do not apply retrospectively to commissions already confirmed.
